Alvin F. de Levie & Associates

There are a multitude of different types of cases that fall under the umbrella of personal injury. Pennsylvania Attorney Alvin F. de Levie outlines them all.

In a single year, personal injuries in the United States exceed the 2 million mark. A majority of these are cases which exclusively require medical attention.”

— Alvin de Levie, Esq.

PHILADELPHIA, PENNSYLVANIA, UNITED STATES, May 31, 2018 /EINPresswire.com/ — During the course of our lives, most of us have had our fair share of nicks, cuts, bruises and other types of injuries. Some of them are due to no fault of ours and could range from faulty products to negligence in service. Things that are out of our control and cause us injuries can be labeled as a personal injury.

Accidents can’t always be avoided, but when there’s evidence or can be proved that it could have been, there is a potential personal injury case on hand. In a single year, personal injuries in the United States exceed the 2 million mark. A majority of these are cases which exclusively require medical attention.

The list of cases that fall under the umbrella of personal injury is long. The following are the some of the most common types of personal injuries so that you are aware in case you or someone you know has been injured by any of these occurrences.

Defective Products

The risks that defective products can pose to our health are boundless. It’s ironic when you consider the number of 'safe' products advertised and available on the market today. A major category of these products is food. Food contamination by manufacturers can have various adverse effects.

Though these effects can be mild in many individuals, it can severely affect others. These effects are either because the food was contaminated with ingredients that people are allergic to, or that these contaminants weren’t part of the original constituents that should have been in the food. It could range from people being sick due to peanuts in their food when they are allergic to it, or to people with lactose or gluten intolerance.

Medical Malpractice

People naturally trust medical practitioners to take care of their problems. Unfortunately, there are times when medical practitioners are negligent and make errors that could have been avoided. These errors that doctors make can vary from an incorrect diagnosis, wrong prescription drug, mistakes during surgery/childbirth, delay in treatment, and more.

Usually, the results of these mistakes are severe physical incapabilities which in some cases, can last for a lifetime. Consequently, the individuals victimized by these mistakes have no choice but to exercise their rights by employing the services of a medical malpractice lawyer.

Accidents Due to Crime and Abuse

Many times, we unknowingly become a part of a situation which we were never expecting. If you have ever been robbed or been sexually assaulted, for example, you can pursue a personal injury case. Child abuse and elderly abuse also come under the purview of personal injury law.

Road Accidents

Despite the safety precautions that have been implemented in the US, road accidents are still unavoidable, because there are too many factors in play while driving. Motorists, pedestrians, cyclists, and buses are constantly affected by accidents, which can sometimes be fatal. Also, most of the time, these accidents are due to human errors.

On the road, we often aren’t in a great mood, are tired, or just plain stubborn, and these could result in errors in judgment. A fender bender isn’t a huge deal, but severe accidents can leave victims disabled physically, mentally, and, in extreme cases, result in death. Compensations are mostly awarded to those affected. The guilty party in this scenario is instructed to cover all the damages incurred.

If you've been a victim of any such accidents that resulted in personal injury, you will need the assistance of an experienced personal injury lawyer. At the Law Offices of Alvin F. de Levie & Associates, we will help you navigate through the legal process and fight for the compensation to which you are rightfully entitled. Money Doctor Neil Gallagher Reveals 3 Reasons Why Estate Planning Is Important

Money Doctor Neil Gallagher

Protect Your Assets & Safeguard Your Future

LOS ANGELES , CA, UNITED STATES, May 31, 2018 /EINPresswire.com/ — Founder, President, and CEO of Gallagher Financial Group Inc., Money Doctor Neil Gallagher has been a successful entrepreneur, investment counselor, and financial journalist for more than two decades, managing over one billion in assets and serving over one thousand clients world-wide. In addition, he also hosts weekly radio programs covering financial communication, the psychology of investing, wealth creation, family enrichment, and the importance of estate planning.

“Whether you are leaving a huge financial windfall behind for your offspring or a smaller monetary account, it is important to create an estate plan which allows greater control, privacy and security of your legacy,” Gallagher instructs.

“Interestingly, 55% of Americans don’t even have a will, which can be an alarming thought, especially in certain states. In the state of Connecticut, for example, there are certain laws that mandate how your assets will get distributed,” he continues.

Although “basic wills” are available online, Gallagher highly recommends, “sitting with a professional to develop a plan that works for you”.

3 Reasons Why People Do Estate Planning:

1. Probate Fee & Tax Reduction
If your assets are too high, you will be required to pay estate taxes to your state and possibly federal estate taxes depending upon the value of the accounts. And, probate fees may be assigned as well. Therefore, it is beneficial to work with an attorney who can help explain the laws and help you make smart decisions regarding to whom, where and when to designate your assets.

2. Asset Protection
It is extremely important to protect your assets. A professional may also suggest things like an Umbrella Insurance Policy which provides excess coverage if you are unfortunately involved in a car accident and go through your auto insurance limits. Protect your assets so your loved ones are protected as well.

3. Control and Management
Estate planning alleviates the fear and guarantees your final wishes regarding asset distribution. Family dynamics often can be tricky. Estate planning takes away the guessing and provides a detailed plan of who, what, where and when.

Bard Faces Second Bellwether in IVC Filter Litigation

How an inferior vena cava filter works to stop blood clots from causing an injury in patients.

Ivc filter lawsuits are being filed nationwide.

As high as 80% of patients are discovering an injury caused by the IVC filter after a CT Scan.

Schmidt National Law Group continues to file IVC filter lawsuits

Problems are being reported to the FDA, and the FDA has issued warnings and taken products off the market, but that doesn’t really help the person who has the implants.”

— Martin Schmidt, Esq

SAN DIEGO, CA, UNITED STATES, May 31, 2018 /EINPresswire.com/ — Just two months after a jury handed down a multi-million-dollar verdict against the company, medical device manufacturer C.R. Bard is facing its second bellwether trial in the multidistrict litigation involving its inferior vena cava filters.

Bard faces roughly 3,600 lawsuits over its IVC filters, which plaintiffs say caused them serious injury and, in some cases, death. The lawsuits were consolidated into an MDL in the District of Arizona in 2015. So far, one case has gone to trial, which returned a $3.6 million verdict in favor of the plaintiff in late March. The second case is set for trial beginning May 15.

The plaintiffs in these lawsuits claim Bard’s IVC filters caused them serious injury. They allege the cage-like devices used to trap blood clots broke and fractured, migrated from their original locations, moved into the heart or lungs, or even punctured the vena cava, the body’s largest vein.

Schmidt National Law Group works with clients all over the United States—about 80 percent of the clients who thought their IVC filter was still in place, found they could have life-threatening injuries after visiting the doctor for a CT scan.

IVC filters have been implanted in hundreds of thousands of people in the United States over the last several decades. Bard is one of three major manufacturers; the other two, Cordis Corps. and Cook Medical are also facing thousands of lawsuits in state and federal courts across the country.

Medical devices like the IVC filter are often approved by the Food and Drug Administration without the need for rigorous clinical trials, allowing potentially dangerous products through the regulatory cracks and into the hands and bodies of unsuspecting patients.

There have been a number of IVC filter recalls over the years, which take potentially deadly devices off the market, but what about the patients who already have a faulty filter in their body? Attorney Martin Schmidt, of Schmidt National Law Group, says filing an IVC filter lawsuit is the only way to help patients seek justice and hold medical device manufacturers like C.R. Bard, Cordis, and Cook accountable.

“[IVC filter] problems are being reported to the FDA, and the FDA has issued warnings and taken products off the market, but that doesn’t really help the person who has the implants,” says Schmidt. “The FDA doesn’t provide any remedy whatsoever for the person that was harmed by a device that failed, and the only person who can really help them is a plaintiff attorney who is experienced in dealing with potentially adverse medical devices and drugs.”

Schmidt National Law Group is experienced in dealing with bad medical devices and is filing cases against the manufacturers of faulty IVC filters. Call Schmidt National Law Group toll free at 800-631-5656 or visit NationalInjuryAdvocates.com.

Three nurses received unique awards:

Nursing Inspiration Award: Macky Meephakdee, RN, Intermountain Medical Center OR. Macky was born and raised by his grandparents in a small farm town in Thailand. He found his passion for nursing while caring for his grandparents. Macky was the first in his family to get an education past the fifth grade, working odd jobs and selling snacks to pursue his education. His high grades earned him a scholarship to Khon Kaen University, where he earned a bachelor's degree in nursing and began practicing in an operating room in Thailand. In 2014, he came to Utah, studied English as a second language, and by 2016, completed all of the regulatory requirements and passed all national and local language and clinical exams to earn a comparable BSN degree and be licensed to practice nursing in the United States.

Nursing Innovation Award: Carolyn Reynolds, RN, MSN, APRN, Intermountain Central Office. Carolyn is the director of Intermountain's Pediatric Clinical Program, and she's held progressive roles in pediatrics since 1989. In partnership with Stanford, she started Intermountain's GRAD program to support young adults with chronic disease. The program offers resources and tools to help prepare teens to successfully manage their own health and make a successful transition to adult care.

Nursing Influence Award: Michelle Van De Graaf, RN, Intermountain Medical Center Acute Cardiovascular Unit. When Michelle was serving in the Peace Corps in the Republic of Kiribati, she noticed that family members provided much of the care for their loved ones as part of their culture. So, eight years ago, with the support of her team at Intermountain Medical Center, she started the Partners in Healing program, which helps engage family members in their loved one's care and enhances their transition from the hospital to home. The response to the program has been extremely positive from patients, family members, and caregivers. Over 90 percent of patients involved in the program gave it a rating of 4 or 5 on a 5-point scale for helping them be ready for discharge and comfortable in caring for the patient at home — and patients who've participated in the program at Intermountain Medical Center have experienced a 65 percent reduction in readmission rates. Today, Partners in Healing is being implemented across Intermountain.

Wakely Analysis Cited in Latest CBO Health Insurance Projections

TAMPA, FLORIDA, UNITED STATES, May 29, 2018 /EINPresswire.com/ — The Congressional Budget Office released its latest projections on health insurance coverage and costs in the United States (https://www.cbo.gov/system/files/115th-congress-2017-2018/reports/53826-healthinsurancecoverage.pdf).

Researchers Find Genetic Link to Rare, Life-Threatening Lung Condition

Chronic thromboembolic pulmonary hypertension (CTEPH), which is a rare but deadly condition that can occur after initial treatment of a blood clot in the lung, may be an inherited genetic disease, according to new study.

The most important result of these findings is that we’ve identified a number of large pedigrees with multiple cases of CTEPH in the family.”

— Dr. Mark Dodson, Intermountain Medical Center

SALT LAKE CITY , UT, USA , May 29, 2018 /EINPresswire.com/ — Chronic thromboembolic pulmonary hypertension (CTEPH), which is a rare but deadly condition that can occur after initial treatment of a blood clot in the lung, may be an inherited genetic disease, according to a first-of-its-kind study from researchers at Intermountain Healthcare in Salt Lake City.

When clinicians treat a pulmonary embolism, or blood clot in the lungs, they use blood thinners to break up the clot and reopen the affected artery. However, in patients with CTEPH, the blood clots don’t dissolve, which leads to a rise in blood pressure and strain on the heart as it tries to pump blood through the still-blocked arteries in the lungs.

“Until now, no genetic link has been identified to indicate CTEPH is hereditary,” said Mark Dodson, MD, PhD, medical director of the chronic thromboembolic pulmonary hypertension program at Intermountain Medical Center. “Our research suggests that CTEPH may in fact be a genetic disease, with inherited genetic risk factors passed down from one generation to the next.”

Results of the study were presented at the American Thoracic Society’s annual conference this month in San Diego.

CTEPH is a long-term complication that occurs in some patients who’ve had a pulmonary embolism, which is a blood clot that typically starts in the legs, then travels to the lungs. Usually, patients with a pulmonary embolism have shortness of breath, low blood oxygen levels, chest pain, and/or lightheadedness.

Doctors treat pulmonary embolism with blood-thinning medication, which usually dissolves the blood clots over a period of months and prevents new clots from forming. For reasons that aren’t well-understood, blood clots don’t properly dissolve in patients with CTEPH, and so additional treatments are needed.

CTEPH occurs in about four percent of patients who’ve been diagnosed with a pulmonary embolism, but can also occur in patients who’ve never had one. Up to 25 percent of patients diagnosed with CTEPH have no prior history of acute pulmonary embolism.

For the study, researchers reviewed medical records linked to the Utah Population Database to identify all patients who have ever been diagnosed with CTEPH in the stage of Utah. The Utah Population Database (UPDB) is a unique Utah resource that contains detailed genealogy records for approximately 4 million Utah residents dating back to the Mormon pioneers.

In many cases, genealogy data extends up to 15 generations deep. For this study, the researchers required that individuals included in the study have genealogy data in the UPDB that extends back at least three generations. The researchers then used the genealogy records in the UPDB to compare the average pair-wise relatedness of all possible pairs of patients with CTEPH to that of matched controls without CTEPH.

Researchers identified 141 Utah CTEPH cases, of which 66 met their criteria for adequacy of genealogy information. These 66 CTEPH cases were significantly more closely related than were controls, suggesting that the increased relatedness of CTEPH subjects is unlikely to have occurred by chance.

“The most important result of these findings is that we’ve identified a number of large pedigrees with multiple cases of CTEPH in the family,” said Dr. Dodson. “These pedigrees are ideal tools to now use gene sequencing to identify the genes that cause CTEPH in these families.”

Funding for the study funding was provided by donors to the Intermountain Research and Medical Foundation, which provides seed grant money for worthy research projects, such as this one, that lead to clinical applications.

Members of the research team included: Lynette Brown, MD, PhD; Gregory Elliott, MD; and Kristina Allen-Brady, PhD, from Intermountain Healthcare, and Lisa Cannon-Albright, PhD, from the University of Utah.
